State Trying to Sell Death Drugs

In a bizarre turn of events, Oregon is now trying to sell the drugs used to kill in death penalty cases, and they include controlled substances. In essence, the state wants to offload narcotics and find a way to do it without getting busted by the feds.

Sound strange? It is. When Governor John Kitzhaber declared a moratorium on actually killing death row inmates in our state, the idea of recouping the money spent on lethal injection drugs came up. There’s a market, for sure. Recently, states that ran out of the drugs were trying to import them (specifically Sodium Thiopental) and some got in trouble with the federal government because they tried to do an end run around the rules.

And that’s the rub. The states that ordered drugs from India didn’t have the proper permissions and had to return them. The controlled substances in question hadn’t gotten the proper approvals from the FDA or the DEA. You need an import license and paperwork, even if you are a state.

So, now that Oregon has product to sell, the same rules are coming into play from another direction. We can’t simply drive over to Texas and sell them the $18,000 worth of drugs. The answer may come in the form of a drug broker – someone empowered to take the drugs from us and resell them to someone else. This is usually the manufacturer of the item, although it can be a licensed wholesaler as well.

In the end, it’s more of a political statement than a real money saver. The statement is pretty obvious, “No one dies on my watch.” Whether the drugs in question are actually sold or merely destroyed (they are said to have a three-year expiration date) – the message will be the same.
